1. Who We Are 

FundiAI (Pty) Ltd (“FundiAI”, “we”, “us”) is a South African AI-assisted business consultancy, registered under number 2025/739927/07, with its principal place of business at 16 Middel Street, Kuilsrivier, Cape Town, 7580. 

We provide AI-assisted services including social media management, website design and management, invoicing software, content creation, and related business support services (“Services”). Specific services are provided under individual Service Level Agreements (“SLAs”) or Licence Agreements signed between FundiAI and each client. 

2. Acceptance of Terms 

By visiting www.fundiai.co.za, contacting us, or using our services, you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree, do not use our website or services. 

3. Our Services 

3.1 Poppie – Social Media Management 

AI-assisted social media content creation, scheduling, publishing, analytics, and strategy for Facebook and Instagram. Available as: Social Media Assistant (R99/mo), Social Media Manager (R199/mo), and Social Media & Ads Manager (from R250/mo). A once-off R250 setup/integration fee applies to all Poppie packages. 

3.2 Chad – Website and eCommerce 

WordPress and WooCommerce website build, setup, and ongoing managed services (hosting administration, maintenance, updates, backups, limited revisions, and AI-assisted content). Setup fee as quoted per project scope. Ongoing management from R199/mo (standard) or R649/mo (full eCommerce store). 

3.3 FundiAI Invoicing App 

A once-off licence for FundiAI’s invoicing application for South African small businesses. Covered by a separate Licence Agreement. 

3.4 Coming Soon 

FundiAI is developing additional AI Fundi services: Bakkies (customer support/chatbot), Luthando (business strategy), Lerato (human resources), and Ruaan (cyber security). These will be covered by separate agreements. 

3.5 The Fundi File 

A digital brand knowledge base used to personalise AI Fundi outputs for your business. The Fundi File is built from information and assets you provide to FundiAI. You retain ownership of your business data within it. 

4. AI-Assisted Services Disclosure 

FundiAI’s services are delivered using a combination of human expertise and AI tools: 

  • Content, copy, strategies, suggestions, and other deliverables may be generated or assisted by AI tools. 
  • AI outputs may contain errors or inaccuracies. Clients are responsible for reviewing and approving all deliverables before use or publication. 
  • FundiAI’s human team provides oversight and quality control throughout. 
  • FundiAI is not responsible for inaccuracies in AI-generated content that clients publish without adequate review. 

Clients must disclose that content is AI-assisted where required by applicable law or platform policies. 

5. Service Level Agreements 

Each service is governed by a specific SLA or Licence Agreement signed between FundiAI and the Client. The SLA sets out the precise scope, pricing, payment terms, revision policies, approvals workflows, and legal protections. In the event of conflict between these Terms and a signed SLA, the SLA prevails for the specific service it governs. 

6. Pricing and Payment 

  • Monthly services are billed monthly in advance. 
  • Once-off services (website builds, licences) are billed as set out in the relevant agreement. 
  • Accepted payment methods: EFT (bank transfer) and PayFast. 
  • Prices are subject to annual review. Existing clients will receive reasonable written notice of any price changes. 
  • Fees paid are non-refundable except where required by law. 
  • For Poppie Social Media & Ads Manager: FundiAI’s monthly fee does not include your advertising budget. Ad spend is a direct, separate cost to you, charged to your own payment method. 

7. Client Responsibilities 

  • Provide accurate, complete, and lawful information for service delivery. 
  • Ensure you own or have rights to use all assets (logos, images, copy, trademarks) supplied to FundiAI. 
  • Review and approve all deliverables before publication or use. 
  • Comply with platform terms of service (Meta, Google, WordPress, and others). 
  • Keep access credentials secure and report any suspected compromise immediately. 
  • Maintain your own POPIA compliance for your customers and business data. 

8. No Guarantees 

FundiAI does not guarantee specific outcomes from its services, including: 

  • Social media follower growth, reach, engagement, leads, or sales. 
  • Website search engine rankings, traffic volumes, or conversion rates. 
  • Ad campaign performance, return on ad spend, or lead generation. 

Results depend on many factors outside FundiAI’s control, including market conditions, platform algorithms, product/service quality, and client business practices. 

9. Intellectual Property 

Deliverables created specifically for a client and approved under a signed SLA become the client’s property (subject to full payment). FundiAI retains all rights to its internal systems, workflows, templates, AI prompts, automation logic, and know-how (“FundiAI Background IP”). Clients may not reproduce, sell, or distribute FundiAI Background IP. Third-party assets (themes, plugins, fonts) remain subject to their respective licences. 

10. Website Use 

You may use www.fundiai.co.za for lawful purposes only. You may not: 

  • Use the website in violation of applicable laws. 
  • Transmit spam or harmful content through the website. 
  • Attempt to gain unauthorised access to our systems or servers. 
  • Scrape or systematically collect data from our website without permission. 
  • Reproduce or republish website content without prior written permission. 

11. Third-Party Links and Services 

Our website may link to third-party sites. FundiAI is not responsible for those sites’ content or privacy practices. FundiAI uses third-party tools and platforms to deliver services and is not liable for failures, interruptions, pricing changes, or policy changes by those providers. 

12. Limitation of Liability 

  • FundiAI is not liable for indirect or consequential losses (lost profits, revenue, reputational harm, data loss) from use of our website or services. 
  • FundiAI’s aggregate liability is limited as set out in the applicable SLA, or (if no SLA applies) to fees paid in the 30 days preceding the event giving rise to the claim. 

Nothing in these Terms limits liability for fraud, gross negligence, death, or personal injury, or any other liability that cannot lawfully be excluded. 

13. POPIA and Privacy 

FundiAI processes personal information in accordance with POPIA and our Privacy Policy (available at www.fundiai.co.za). Please read our Privacy Policy for full details.

15. Changes to Services and These Terms 

FundiAI may update these Terms from time to time. The updated Terms will be published on our website with an effective date. Continued use after the effective date constitutes acceptance. Material changes affecting existing clients will be notified in advance. 

16. Governing Law 

These Terms are governed by South African law. Disputes will be resolved in accordance with South African law, in Cape Town, unless otherwise agreed in writing.
